Terms and Conditions

Your order is accepted; however, acceptance and all processing performed by ANAPLEX CORP. are expressly conditioned upon your acceptance of the following Terms and Conditions.

1. Payment Terms

• Payment terms are Net 30 days.
• A 1.5% monthly service charge will be applied to overdue accounts.
• Invoices containing charges for precious metals are payable within 10 days.
• If legal action is instituted to collect an outstanding account, the customer agrees to pay reasonable attorney fees and court costs.
• This contract for processing is entered into in Paramount, California.

2. Responsibility Policy

For salvage parts, prototype parts, experimental orders, and minimum charge orders, ANAPLEX CORP. will not accept responsibility for damage to parts.

3. Damage or Shortage Claims

In the event of damage during processing or shortages, the customer’s account shall be credited according to the conditions outlined below.

All credits are conditional and will only be issued if ANAPLEX CORP. is notified of defective work or shortages within 10 days of delivery.

4. Industry Standards

Members of the Metal Finishing Association of Southern California remind customers of the established practices in the metal finishing industry. These practices have been formally adopted as a Statement of Policy.

Even with the best available science and trained personnel, hazards still exist in electroplating and metal finishing processes. To avoid misunderstandings, the following conditions apply to materials accepted for processing.

5. Processing Instructions

When materials are provided with detailed instructions for treatment, our responsibility is limited to carrying out those instructions.

The type of materials, tolerances, and specifications must be declared in writing prior to processing.

6. Limitation of Liability

Our liability for any cause is limited to the cost of direct labor and materials for the products directly damaged by our processing, or three times the processing charges, whichever is less.

All service charges are based on this limitation of liability policy.

7. Additional Liability

Liability exceeding the limitation stated above will only be assumed if agreed to in writing prior to processing and may require additional service charges.

8. Acceptance of Processed Materials

Parts and materials processed by ANAPLEX CORP. will be considered accepted and satisfactory unless we are notified of:

• Damage
• Shortages
• Other discrepancies

within 10 working days of receipt.

Rejected parts must be returned to us for rework.

Any further processing or assembly of unsatisfactory parts by the customer or a third party constitutes a waiver of liability on the part of ANAPLEX CORP.

9. Salvage Processing

When work involves salvaging parts or materials, processing is performed on a best-effort basis.

No liability will be assumed unless specifically agreed upon in writing prior to processing.

10. Material Imperfections

If the results of metal finishing operations are unsatisfactory due to:

• Metal imperfections
• Variations in material composition or grade
• Manufacturing or fabrication defects
• Improper design for plating or finishing
• Other variables outside our control

The customer will still be responsible for payment of the contracted finishing charges.

11. Customer Purchase Orders

ANAPLEX CORP. is not bound by terms appearing on customer purchase orders that attempt to impose conditions different from these Terms and Conditions.

Failure to object to such terms does not constitute acceptance of them.

These Terms and Conditions, along with those on ANAPLEX CORP. packages, invoices, and technical data sheets constitute the entire agreement between the parties.
